The Family Court framed the issues and on an appreciation of the material evidence on record found that the wife had earned a gross salary of Rs.17,172/in the month of May-2013. The Court held that the appellant-wife was serving with the Railways and she had come up with a false case before the Family Court that she was not employed with the Railways and she was not earning any salary. After considering the salary slips produced by the respondent-husband on record, the Family Court found that there was change in circumstances and the appellant-wife was earning an amount of more than Rs.7000/- that was directed to be paid by the respondenthusband towards her maintenance. The Family Court observed that the respondent-husband was directed to pay a sum of Rs.5,000/- for the child who was residing with the appellant-wife. The appellant-wife was, therefore, not required to shoulder the responsibility of the daughter who was being paid a sum of Rs.5000/- by the respondenthusband. Having held that there were change in circumstances, in view of the job secured by the appellant-wife in the Railways, the Family Court held that it was necessary to rescind the order granting permanent alimony of Rs.7,000/per month to the wife and, hence, the order awarding permanent alimony was cancelled by the impugned judgment dated 27.02.2014.
