1.Consent terms have been signed and are handed in. These consent
terms have been signed on behalf of the petitioners by one Mr. Priyank Mehta
and on behalf of the respondents Mr. K. Chandrasekran. Both are authorized
signatories. The consent terms have also been signed by the advocates of
respective parties. They are taken on record and marked “X” for
identification.
2. By consent, clause (8) is partly modified as follows.
2. For the purposes of this clause, the date of default shall be the date of

post dated cheque plus the grace period mentioned in clause (5) of the consent
terms.
3.In the event of such default and company petition reviving and standing
admitted without further reference to the Court as provided in the Consent
Terms, service of the petition under Rule 28 of the Companies (Court) Rules,
1959 shall be deemed to have been waived.
4.The petition shall then be advertised in two local newspapers, namely (i)
Free Press Journal (in English); (ii) Navshakti (in Marathi); as also in the
Maharashtra Government Gazzette.
5.The petitioner shall within two weeks of such default deposit an amount
of Rs.10,000/- toward publication charges with the Prothonotary & Senior
Master, under intimation to the Company Registrar, failing which the petition
shall stand dismissed for non-prosecution without further reference to the
Court
6. The company petition is disposed of in these terms.
7.This petition has been settled after a truly Herculean effort by the
learned advocates for both sides. I must record my appreciation to both Mr.
Ankhad and Ms. Sadh.
