1.Learned advocate for the petitioner submits an additional
affidavit dated 10th February 2014. Exhibit 2 to that affidavit shows
that the Company has, on 2nd July 2013 i.e. after filing of this
petition in February 2013 paid to the petitioner the sum of Rs.
4,88,812.50/- which is the total amount of the petitioner’s principal
claim. The remaining claim made by the petitioner of Rs. 48,700/-
is towards interest.
2.Learned advocate for the petitioner, therefore, seeks leave to
withdraw the petition with liberty to file suitable proceedings for
the recovery of the remainder, i.e. overdue interest.
