The Chamber Summons is taken out by the Plaintiff for amendment of the plaint, in terms of the schedule annexed to the Chamber Summons. Basically, by this amendment, the Plaintiff wants to incorporate averments concerning events subsequent to the filing of the suit, which have inter alia resulted in Defendant No.1 society terminating the suit agreement for sale, specific performance of which is sought in the suit herein. Having regard to the averments made in the affidavit, in support of the Chamber Summons and also the documents to be incorporated in the plaint, a clear case for allowing the amendment is made out. The amendment sought to be introduced is necessary to determine the real issue in controversy between the parties.

2 Accordingly, Chamber Summons is made absolute in terms of prayer clause (a). The amendment to be carried out within two weeks from today. Amended copy of the plaint to be served on the Defendants.
