Mhi 2 BA-1817-14.sxw Bhosale, proprietor of M/s. Shree Imports visited Union Bank of India and submitted six pay-in-slips before the Cashier. That the pay-in-slips showed that the said persons wanted to deposit Rs.10,87,34,700/- in the account of Manibhadra Trading Co. and Rs.5,06,000/- in the account of Accure Impex Pvt.Ltd. which they were operating in Union Bank of India. It is pertinent to note that no cash was actually deposited. The Cashier had stamped the pay-in-slips as cash received although no cash was received and same was approved by the present applicant and endorsed as true and correct. Soon thereafter, Nikesh Shah had also presented a cheque purportedly issued by Manibhadra Trading Co., a proprietary firm of the father of Nikesh Shah. The said cheque was signed by Tarachand Shah on 16.12.2008 and the cheque was issued in favour of Shree Imports. Thereafter, Nikesh Shah had tendered another cheque on 5.1.2009 purportedly issued on account of Shree imports. It was drawn on `Self'. He also submitted RTGS for transfer of Rs.10 crores to the account of P.K. Financial Services, Mira Road (East) which was operated in HDFC Bank Ltd. The applicant herein had verified and authorized the said transfer although he was fully aware that there has been no physical depositing of cash along with the payin-slips.
