Heard the learned counsel for the applicant, the learned Assistant Public Prosecutor for the State and learned counsel Mr. P.B. Gapat for the intervenor.

The deceased Sanjay had committed suicide on 24^th December 2013 by consuming poison at his own house. The applicant is his neighbour. The applicant had a quarrel with the deceased on 23^rd and 24^th December 2013 on the ground that the deceased had knocked the door of the applicant when husband of the applicant was absent. It is alleged that the deceased had knocked the door with ill intention. The applicant and her father in

law had a quarrel with the deceased on 24^th December 2013 in the morning. The husband of the applicant and applicant both had again quarreled with the deceased in the afternoon. Husband of the applicant was armed with a wooden stick. He had threatened the deceased that he would break the legs of the deceased, if he came out.

It is alleged that since the deceased got frightened due to the threats given by the applicant and her husband, the deceased committed suicide by consuming poison.

I have gone through the F.I.R. Even if the allegations made in the F.I.R. by wife of the deceased are accepted to be true and correct, it is very difficult to say that applicant had in any manner abetted commission of suicide by the deceased. Husband of applicant was naturally furious because of misbehaviour on the part of the deceased. There was no intention to instigate the deceased to commit suicide. In the circumstances, I pass the following order.

(i) Applicant be released on bail in the sum of Rs. 10,000/- (Rupees ten thousand) with one solvent surety in the like amount.

(ii) She shall attend the office of I.O. daily between 4.00 p.m. to 5.00 p.m. for a period of five days with effect from 31^st January 2014 and thereafter shall continue to attend the office of Investigating Officer as and when required.
