Perused the impugned order passed by the learned Sessions Judge in Sessions Case No. 56/2008. The application for cancellation of warrant of the applicants has been rejected by the learned Sessions Judge and they have been taken into custody.

applicants that the applicants never received summons either from the Magisterial Court or from the Sessions Court. As such, they were not aware of the progress of the case. It is submitted that the applicants appeared before the trial Court suo-moto and offered sureties also. In the circumstances, they should have been taken in to custody by the Sessions Court and should have been released on bail immediately.

It is ordered that the applicants be released on bail in the sum of Rs. 15,000/- (Rupees fifteen thousand), each, with one solvent surety in the like amount for each of the applicants in Sessions Case No. 56/2008 of the Court of the Additional Sessions Judge, Ambajogai.
