From 31.12.2013 he has been behind bars as under-trail prisoner except for the period of around 30 days for which he was kept in J.J. Hospital, Mumbai for operation performed on his eye as per the statement made by the learned counsel for the applicant. Present applicant is sitting M.L.A. of this State and when bail order was cancelled by this Court, he was the member of State Ministry. It is the case of present applicant that many accused from this case are granted bail by Sessions Court and so, on the ground of parity, he is entitled to get bail. It was submitted that only because no custodial interrogation of the present applicant was made, the bail was cancelled and in view of the aforesaid circumstances, he is entitled to get bail. It was submitted that present applicant is not Minister of State at present and so, it cannot be said that he is in a position to influence the witnesses, tamper the prosecution witnesses. The learned counsel for the applicant submitted that if there is material to show that due to the alleged crime, loss is caused to the Municipal Council, Jalgaon (at present Municipal Corporation), he is ready to deposit any amount, if direction in that regard is given by this Court.
