2.Mr.Vashi, learned senior advocate for the Plaintiff states that
Defendant No.5, the Income Tax Officer is dropped as party
Defendant to the proceeding. Leave to amend to that extent.
Amendment to be carried out within one week from today.

3.The remaining parties are personally present in Court. They
have each affirmed a consent affidavit. These affidavits are
tendered along with the consent terms. The consent terms are
taken on record and marked ‘X’ for identification. Undertakings in
the consent terms are accepted as undertakings to the Court.
4.There will be an order in terms of the consent terms finally
disposing of the suit itself. In addition to what is stated in clause 7
of the consent terms, upon completion of the various acts required
to be done by the consent terms, the Court Receiver to stand
discharged without passing accounts but on payment of his cost,
charges and commission as agreed in clause 7.
5. Suit is disposed of in these terms.
