1.At this stage, when the Plaintiff is under cross examination,
he instructs his advocate, Mr. Kane, to apply for a withdrawal of the
suit. In my view, having regard to the manner in which the suit is
laid, the Plaintiff’s advanced years and state of health, this is in the
Plaintiff’s best interest. The Plaintiff is personally present in Court,
and has already been administered oath. He confirms his
instructions and that he wishes to withdraw the suit.
