Adv.Mr.Patil submits that petitioner is entitled to allotment and possession of a tenement as a freedom fighter. Learned A.G.P. points out that as yet this Court has not issued any notice, but then there is no letter of allotment in favour of the petitioner, hence there is no question of handing over possession to the petitioner.

Petitioner appears to be a freedom fighter and presently is 93 years old. His claim for such allotment also appears to have been

accepted.

In this situation, without observing anything on merits, we find that interest of justice can be met with by permitting the petitioner to make an appropriate representation to respondent No.1. If such representation is made by the petitioner within a period of 3 weeks from today, respondent No.1 shall take necessary decision upon it within further period of 8 weeks. In the said representation, the petitioner is free to point out the choices or places where he seeks allotment of a tenement.

Respondents to consider such request in accordance with Law. Leaving all rival contentions open and giving liberty to the petitioner to approach this Court again, if his grievance subsists even thereafter, we dispose of present writ petition. No costs.
