Heard. Adv.Mr.Barlinge for the petitioner, Adv.Mr.Patil for respondent No.8, Adv.Mr.Talekar for respondent No.5 and 6 and Adv. Mr.Bagul for respondent No.7. Learned A.G.P. has appeared for respondent Nos. 1 and 2.

Attempt of Adv.Mr.Barlinge is to demonstrate that respondent Nos. 5 and 6 have obtained validity by playing fraud. He submits that the basic caste certificate itself has also been procured by fraudulent means. He further contends that Scrutiny Committee, in a way, has also assisted them in the matter.

Adv.Mr.Patil appearing for respondent No.8/Committee submits that if an appropriate grievance in relation to fraud or similar malpractice is made by respondent No.8/Committee, the Committee shall consider it in accordance with Law. Adv.Mr.Talekar is raising challenge to locus of the present petitioner.

We find that the petitioner has got remedy and he can move appropriate application before the Committee u/s. 7 of The Maharashtra Scheduled Castes, Scheduled Tribes, De-notified Tribes (Vimukta Jatis), Nomadic Tribes, Other Backward Classes and Special Backward Category (Regulation of Issuance and Verification Of) Caste Certificate Act, 2000 . The Committee is then competent to look into all aspects including the challenge to locus of the present petitioner. If such an application is made by the petitioner to the Committee within 3 weeks from today, Committee shall process the same in accordance with Law and after giving necessary opportunity to all concerned, pass appropriate order within further period of 8 months thereafter.

Keeping all rival contentions open, with these directions, we dispose of the present writ petition. No costs
