Petitioner who was appointed on 18.6.2003 as Assistant Teacher in the pay scale of Rs.4500-7000 has come before this court praying for direction to Respondent-Management to forward proposal to the Education Officer to extend to the petitioner pay scale of Rs. 5500-20000 as referred to in the Writ Petition which the petitioner claims to be meant for the post of Art Master.

Petitioner's appointment as Assistant Teacher received permanent approval way back in April 2007. Thereafter, it appears,

petitioner has completed Art Master's course and thereupon requested for grant of pay scale Rs.5500-20000 for the Art Master. However, Petitioner's request was not being acceded to and thus he is before this court.

There appears to be some dispute about authenticity of the course of Art Master completed by the petitioner as well as the course adopted by the petitioner to secure the same.

In the scenario, we deem it appropriate that interest of justice can be met with by directing Respondent-Management to forward petitioner's proposal to the Education Officer for grant of requisite pay scale as per law, who shall decide the same on merits, by affording opportunity of hearing to all parties concerned, including the petitioner as well as the concerned respondents in the writ petition.

With directions, as aforesaid, petition stands disposed of.
