1]In view of reply by the respondent no.2, Advocate

Shri Natu submits that as the resolution passed by Zilla

Parishad is only recommendatory and final decision is to

be taken by the Deputy Director of Education, the
petitioner will be satisfied if the said authority

extends opportunity of hearing to the petitioner as also
to the respondent no.4 and takes necessary decision in a
time bound manner.

2]Advocate Shri Bondar appearing for the respondent
no.2 has no objection.

3]Learned AGP appears for the respondent no.1.

4]Advocate Shri S.S. Thombre appearing for the
respondent no.4 submits that the statute provides
challenge to the resolution of Zilla Parishad before the
Additional Commissioner.

5]It is not necessary for this Court to go into rival
contentions.

6]We grant request made by Advocate Shri Natu to add

the Deputy Director of Education, Aurangabad, as the
respondent no.5. Necessary amendment be carried out
forthwith.

7]Learned AGP waives notice for the added respondent
no.5.

8]The added respondent no.5 - the Deputy Director of
Education, Aurangabad, shall hear the present petitioner
as also the respondent no.4 and shall take necessary
decision in accordance with law within a period of four

weeks after the parties appear before him. The parties
are directed to appear before that authority on
14.10.2013 and to abide by his further instructions.

9]With these directions and leaving all rival
contentions open, the writ petition is disposed of. No
