floor + two floors. The agreement of which specific performance was sought was one dated 9.09.1994 and the consideration mentioned therein was Rs.18,00,000/-. It was the case of the Plaintiff in the suit that he had paid an earnest amount of Rs.12,00,000/- to the Defendant and it was agreed that the balance amount of Rs.6,00,000/- would be paid at the time of the registration of the Sale-Deed and delivery of possession of the suit property. The said Special Civil Suit No.1066/1994 was contested by the Defendant and came to be decreed vide judgment and order dated 17.04.2007. Since the Defendant failed to execute the SaleDeed, the Executing Court appointed the Assistant Superintendent of the Civil Court through whom the Sale-Deed was executed in favour of the Decree Holder on 24.06.2010. However, after the registration of the said Sale-Deed, it was noticed that some unauthorized persons were in occupation of the suit property at the instance of the Defendant to the Suit i.e. the Judgment Debtor. An application for issuance of possession warrant came to be filed. The said application came to be allowed and the possession warrant came to be issued on 1.07.2010. It appears that on 29.09.2010 the Bailiff along with the Applicant went to the suit property for execution of the possession warrant but the execution was obstructed by the Petitioner herein who claimed that he is in possession of the suit property since long.
