Heard Mr. Suryavanshi. Criminal Writ Petition No.2308 of 2012 as per the available record was dismissed on 19th July, 2013. On 1st October, 2013, in Criminal Application No.398 of 2013, criminal Writ Petition No.2308 of 2012 was restored to original position.
2 Learned counsel for the petitioners says, petitioners
and original complainant had controversies in respect of immovable property situated at Karnataka. Same have been resolved amicably by mediation. He says respondent no.1 -

original complainant in the situation does not desire to prosecute criminal case CC No.50/SW/2007, pending on the file of 29th Court at Dadar.
3 Original Complainant Sadashiv B. Lingayya Shetty is present and identified by learned counsel for the petitioners. He has tendered his Identity Card showing him as a Special Executive Officer for a period from 7th December, 2011 to 6th December, 2016. Photostat of the Identity Card taken on record. In the situation afore referred criminal case is quashed and set aside. Writ Petition is allowed.
