This petition is similar to a group of writ petitions including

Writ Petition No.1694 of 2013. The name of the petitioner in this

petition also appeared in the second list annexed to the affidavit of

the University dated 08.07.2013. The petitioner’s case in this matter

¶22

also is that she had made an application for condonation of short fall

in attendance. She had filed an affidavit dated 01.08.2013. The same includes inter-alia the application dated 21.05.2013 for condonation of short fall in attendance. The application bears the stamp of the University acknowledging the receipt thereof. It appears improbable that the petitioner after having prosecuted the petition, would not have made an application for condonation of short fall in attendance. We see no reason to disbelieve that she had made an application. In the circumstances, her case would be covered by the decision of the University to condone the short fall in attendance of those students, who had made an application for such condonation.

In the circumstances, the writ petition is disposed of by the following order :- i). The delay of shortfall in attendance is deemed to have been condoned by the Management Council of the University of Mumbai. Her result shall be declared and the mark-sheet shall be handed over to her college / institution on or before 02.09.2013 and the college / institution shall forthwith thereupon hand over the same to the petitioner.

In th event of the last date for admission accruing being before 16.09.2013, the delay in applying for admission shall be condoned by the college. Further the examination forms shall be accepted by the University, if filed by 16.09.2013. Needless to add

that this is provided that the petitioner meets all other requirements.

There shall be no order as to costs.

All parties to act on an ordinary copy of this order duly authenticated by the Associate / Private Secretary of this Court.
