Lecturer on 14.2.1997 in the sanctioned aided post in Department of Computer Science. However, on 11.11.1998, she resigned her post and joined VJTI, as Professor in Computer Science, on an aided sanctioned post, which she continues to occupy as a permanent employee, till date. In view of the above, she gives up her claim to rejoin petitioner/university as per the order impugned in this petition. In the above circumstances, the only limited relief, which respondent no.1 is claiming, is that, her services in the petitioner/university as a lecturer, should be considered for retirement dues/pensionary benefits. Both the petitioners and respondent no.1, have no objection, if the petition is disposed of in terms of the minutes of the order.
3 Affidavit is filed by Joint Director, Higher Education on behalf of respondent no.2/State of Maharashtra. In paragraph 3 of the affidavit, it is stated that, respondent no.2 was disbursing the salary of respondent no.1, pursuant to the interim order passed by this Court in above writ petition, till respondent no.1 resigned from the petitioner/university to join VJTI on or about 1998. In paragraph 4, respondent no.2 has stated that it would abide by the orders, which would be passed by this Court.
