1. The learned counsel appearing for the

Petitioner submits that charge-sheet has been
filed in respect of the subject crime. The learned
counsel further submits that from the facts of the

case and the medical evidence, it can be
ascertained that it is a case of committing murder
of Ashfak, son of the Petitioner. The
investigation has not been carried out in a fair
and proper manner. The counsel submits that case
requires to be investigated at the hands of

different agency or at least different
investigating officer than the one who had
investigated the case earlier.

2.The Petitioner is at liberty to file

appropriate, comprehensive representation to
Superintendent of Police (Rural), Aurangabad

regarding specific grievances and prayers, within
TWO WEEKS from today. In case such representation

is filed, we direct the Superintendent of Police
(Rural), Aurangabad to pass appropriate orders on
the same, on its own merits, within further TWO
WEEKS. With these directions and observations the
Writ Petition stands disposed of. We do not
express any opinion on the merits of the claim of
the Petitioner.
