of Rs.2,00,000/- inclusive of interest from the respondent which was the outstanding amount due to the plaintiff in respect of the work undertaken by the plaintiff for construction of five duplex bungalows in the project known as "Summer Sands" at Colva, Margao. It is the case of the plaintiff that by his quotation dated 5/12/1996, he quoted his rates for the suit project, based on the labour costs (without construction material), separately, stating the nature of work item-wise, and the rates. It is the case of the plaintiff that the said rates were accepted by the defendant. It is the case of the plaintiff that the work was commenced on 28/12/1996 and the plaintiff in all raised four running bills, reference to which has been made in the plaint. On account of non-payment by the defendant of the said amount claimed, that notice was issued by the plaintiff on 4/2/1998, calling upon the defendant to pay the balance amount of Rs.1,75,000/- due to the plaintiff. The defendant resisted the suit by filing his Written Statement. In the Written Statement the defendant admitted having entrusted some piecemeal work to the plaintiff. The defendant, however, took the stand that the work done by the plaintiff was defective and the defendant had to spend extra amount to rectify the defect and to complete the work, the defendant also submitted that the plaintiff was paid an excess amount than the amount to which he was entitled.
