the petitioner.
By way of this Public Interest
Litigation, the petitioner seeks a direction
against the respondent no.1 to enquire into the
conduct of the Chief Commissioner of Income Tax
as to why action has not been taken by him in
respect of evasion of Income Tax by respondent
no.3.
A similar petition filed earlier bearing
Writ Petition no. 3986 of 2012 has been

dismissed by this Court on 4th December, 2012 by
passing a reasoned order. Therefore, filing of
this Public Interest Litigation is nothing but
an abuse of process of Court, and by no stretch
of imagination, this petition can be
entertained as a Public Interest Litigation.
We, therefore, summarily dismiss this
PublicInterestLitigationwithcosts
quantified at Rs.5,000/- [rupees five thousand
only] which the petitioner shall deposit in the
Registry of this Court within a period of four
weeks. Upon deposit of such costs, the same
shall be credited in favour of Govt. of
Maharashtra. In case the costs are not
deposited, the Registrar [Judicial] shall take
steps to recover the same as arrears of Land
Revenue.
