applicant and Mr. U.G.Dindore, learned Counsel for the respondent Nos. 1 to 5 at length.

After arguing the application for some time, Mr.Apte, upon taking instructions from the applicant Mr.Madhusudan Mahadev Bendre, who is present in the Court, states that he is not pressing this application provided the applicant is given 3 month's time to vacate the suit premises. He further states that within 2 weeks from today, the applicant and all the adult family members residing with him will file undertaking in this Court after giving advance copy to the other

side incorporating therein;

i) that they are in possession of the suit premises and nobody else is in possession of the suit premises

ii) that they have neither created third party interests nor parted with possession of the suit premises

¶21

iii) that they will hereinafter neither create third party interests nor part with possession of the suit premises

¶22

iv) that they will go on regularly paying rent during the period of 3 months.

v) that they will hand over vacant and peaceful possession of the suit premises to the respondents on or before 16/12/2013.

In view of the above, the Civil Revision Application is disposed of as not pressed.

The applicant is given time upto 16/12/2013 to vacate the suit premises and for handing over possession to the respondents. The applicant will file usual undertaking in this Court in the aforesaid terms within a period of 2 weeks from today. Subject to the applicant filing undertaking, in the aforesaid terms, within 2 weeks from today, the decree passed by the Courts below shall not be executed by the respondents before 16/12/2013.
