By the impugned order the Company Law Board has allowed the application for amendment filed by respondent whereby the respondent is permitted to substitute the words 'Annexure A' with the words 'Annexure E' and is permitted to delete the documents which are annexed from page nos.66 to 74 of the petition.

2 After arguing the matter for some time the learned counsel for the parties agree that the appeal can be disposed of with the following directions-

i) The amendments are listed at Serial No.1, 3 and 4 in the annexure to the amendment application be permitted and the effect thereof will be

considered on its own merits at the time of hearing by the Company Law Board.

ii) As far as amendment No.2 is concerned, the page nos. 66 to 74 of the petition will be retained and will not be removed from the record as directed by the impugned order. The contentions of both the parties as regards these documents are kept open to be decided at the time of hearing of the petition.

The appeal stands disposed of accordingly.
