Vijay Sardarilal Mehra and Anr. Vs Shakuntala Indru Bhavnani and Ors.

It is seen that this court has granted ad-interim order directing the applicant to pay Rs.400/- per month for parking the car. The amount was to be deposited by the appellant.

After hearing this court has come to conclusion that interim arrangement in relation to parking and payment is necessary.

The interim relief is granted in terms of prayer clause

(a) on the following conditions :-

(a) The appellant shall be entitled to use

parking one car of their own and will have to pay to the respondent no.2 directly an amount of Rs.1,000/- per month. Mode of payment should be decided mutually.

(b) The monthly payment shall be made on monthly basis, from the date of judgment of the trial court.

(c) The entire amount of arrears be paid within three months from today.

¶22

(d) Annual proportionate tax liability to the extent of parking one car be borne by appellant.

(e) The tax liability from the date of judgment of trial Court be discharged by appellant within 30 days from the date of intimation.

(f) The amount of Rs.400/- if deposited in court till date be refunded to the appellant.
