2 This application has been filed praying therein permission to withdraw the amount of Rs. 20 lakhs deposited in this Court by the respondent / appellant in Arbitration Appeal No. 1/2012.

3 The learned Counsel for the applicant submits that he may be permitted to withdraw the amount deposited in the Registry of this Court. On instructions from the applicant, he makes a statement that in case the applicant is permitted to withdraw Rs.20 lakhs, the applicant

will furnish Bank Guarantee for Rs.10 lakhs and solvent surety for remaining Rs.10 lakhs to the satisfaction of the Registrar (Judicial).

The learned Counsel for the non applicant opposes the prayer and submitted that the Arbitration Appeal No.1/2012 itself may be taken for final hearing.

4 In the light of above, applicant is permitted to withdraw Rs.10 lakhs by furnishing Bank Guarantee and remaining Rs.10 lakhs on furnishing solvent surety to the satisfaction of the Registrar (Judicial). The application is allowed to the above extent and stands disposed of.

Liberty to the parties to mention the Arbitration Appeal No.1/2012 for final hearing in the month of June, 2013. Interim relief to continue.
