1] The applicant is arrested in connection with C.R.No.190 of 2011 registered with Oshivara police

station alleging offences punishable under section 420, 465, 467, 468, 471, 255, 259, 260, 474 and 475 read with 34 of Indian Penal Code.

She has been arrested on 6^th September 2012.

She is a lady aged 60 years. Her role is set out in the

statement of the complainant and it is alleged that she has borrowed monies by producing a bogus agreement. Equally she has given bogus security documents. The offence alleged involve essentially documents and details of bank account. They have been seized and now charge sheet has also been filed. There is no apprehension that the applicant will not be available for trial. The loan amount is stated to be Rs.33 lakhs. For all these reasons, the following order is passed:-

(i) The Applicant is enlarged on bail in C.R. No. 190 of 2011 on the file of Oshivara police station on her furnishing in the sum of Rs.25,000/- with one or two local sureties in the like amount.

(ii) The Applicant shall not leave the jurisdiction of concerned police station without prior permission of the Trial Court.

(iii) The Applicant shall surrender her Passport, if any, to the concerned Investigating Officer.

(iv) The applicant shall cooperate with the Trial Court for expeditious disposal of the Trial. Any attempt by the applicant to delay the Trial may be a ground for cancellation of bail.

(v) The applicant shall furnish her address to the Investigating Officer where she proposes to reside after bail and during pendency of the Trial. The applicant shall not change her residence without prior intimation of the Investigating Agency.

(vi) The bail is granted subject to condition that the applicant shall not, directly or indirectly, make any inducement or threat to any prosecution witnesses and shall not in any manner tamper with prosecution evidence.

(vii) Any observation/s made in this order shall

not be construed as any finding or any expression of opinion on the merits of the case at the time of Trial.

(viii) It is made clear that any violation or breach of the conditions which are imposed shall entail in cancellation of bail.
