The learned Counsel for the applicant states that in view of the offences alleged against him being triable by the Court of Magistrate, instead of pressing the application for anticipatory bail, he is seeking leave to withdraw the application and allowing him to surrender before the Judicial Magistrate, First Class, Jalna, on 25th February 2013 and meanwhile protect him on terms and conditions, as deem fit and proper. He further requests for giving direction to the Court of Judicial Magistrate, First Class, Jalna to decide his application for bail at the earliest.

The request being made for time to surrender before the Court of law, which would facilitate early completion of investigation, the same deserves consideration having due regard to the fact that the applicant is a government servant. A

statement is made that the applicant is serving at a school at Matrewadi, which is at a distance of 10 kms away from a school at Shelgaon, at which the complainant is serving.

In the aforesaid premises, the application is disposed of as withdrawn. The applicant to surrender before the Court of Judicial Magistrate, First Class, Jalna up till 25th February 2013, as informed. The Court of Judicial Magistrate, First Class, Jalna to decide the application for bail, if any made by the applicant at the earliest, preferably on the same day, in accordance with law, subject to 24 hours advance notice of the same is served upon the other side.

The Investigating Officer of Crime No.10/2013 of Kadim Police Station, Jalna, for offence punishable under Sections 354, 506, 463, 465, 467, 468, 471 of Indian Penal Code, not to take coercive steps of arrest against the applicant up till 11.00 am of 25th February 2013 subject to applicant -

(i) attending Investigating Officer everyday in between 6.00 pm to 8.00 pm till 24^th February 2013;

(ii) staying at the address mentioned in the application and not changing the same without the permission of the trial Court.

(iii) not indulging in any activity of threatening, intimidating or harassing the witnesses, who have or who are likely to disclose the facts against him to the Investigating Officer.
