Notice. Learned A.P.P. appears waiving notice and filed reply. The reply is taken on record. The learned Counsel for the applicant requests for taking up the matter. Learned A.P.P. consents.

The applicants pray for bail in connection with C.R.No. 5/2013, registered with Sarangkheda Police Station, District Nandurbar for offence punishable under Sections 143, 147, 148, 149, 324, 323, 504, 506 of Indian Penal Code and under Section 3 (i) (x) of Prevention of Atrocities Act.

The prayer for bail is founded on the ground that investigation is practically completed. The applicants are in custody for about twelve days. No serious injury endangering the life of the complainant has been caused and the report reveals

that he has sustained only simple injury. The report filed by the prosecution supports the said submission regarding the nature of injury sustained by both the injured involved in the incident. The application for bail was rejected by the Sessions Court only on the count of investigation being in progress. The report reveals that the same is almost completed.

In the aforesaid premises and considering that the offences alleged being not exclusively punishable with imprisonment for life and no other circumstance being pointed for not exercising discretion in favour of grant of bail, the applicants are directed to be released in connection with the said crime, upon furnishing P.R. Bond in sum of Rs.25,000/- each and subject to the conditions that the applicants -

(i) shall stay outside the village Kanadi-Tarfe until further orders;

(ii) shall attend the Investigating Officer, if called in connection with the investigation;

(iii) shall inform their place of abode to the Investigating Officer and shall not change the same without the permission of the Court;

(iv) shall not attempt to threaten, intimidate or harass the prosecution witnesses;

(iv) shall not commit any offence while on bail or for fleeing away;
