The first application is filed for relief of anticipatory bail and the second application is filed for relief of bail. During arguments,

learned counsel for the applicants from first proceedings submitted that on instructions, he wants to withdraw the application. Application No.6262/13 is disposed of as withdrawn.

2] Both sides are heard only in respect of regular bail application filed by Sudam Ghumre.

3] This Court has carefully gone through suicide note left behind by deceased. Crime is registered on the basis of report given by husband of deceased. There are allegations that deceased was forcibly taken away by one Vithal. He had wrongly confined her at a place and he had raped her. Present applicant is said to be relative of Vithal. Suicide note shows that the from the place where deceased was confined, the applicant and others had taken the deceased to her parents house and there she was left with the advice to give punishment to her. She has blamed applicant for insulting her. It is her case that Vithal was at fault but she was blamed by relatives of Vithal. Crime came to be registered u/s 306, 376 etc. of IPC. Learned counsel for applicant submits that at the most offence u/s 306 of IPC can be made out as against applicant Sudam. Submissions made show that he is prosecuting his studies and this Court has permitted him to appear for one examination which is central examination for appointment of teachers. He is behind bars since 11/11/13. In view of these circumstances, this Court holds that it is not desirable to keep applicant behind bars till disposal of the case.

4] In the result, application is allowed. Applicant is to be released on bail on his furnishing PR and SB of Rs.15,000/-. He is not to tamper with prosecution witnesses. He is not to commit similar offence.
