The prayer for bail made by the applicant in connection with Crime No. 16/2012 registered with Georai Police Station for offences under section 392, 457, 380 of the Indian Penal Code deserves to be upheld inspite of the same is objected by the prosecution on the count that the applicant has been involved in such type of offences prior to the offence in question. The prayer deserves to be upheld having regard to the fact that inspite of the crime had been registered on 25/01/2012; the applicant arrested on 11/11/2012, the Investigating Agency is not able to collect any tangible material prima facie showing involvement of the applicant in Crime in question. However, considering the fact pointed out by the ld. A.P.P. and nature of accusation, it appears proper to seek heavy bail and impose certain conditions to ensure that the order of bail is not misused for any other oblique purpose.

The applicant is directed to be released on bail upon furnishing P.R. bond in the sum of Rs.50,000/- with one or more sureties to make up the like amount and subject to conditions that the applicant after his release :

(i) shall attend Investigating Officer on every alternate day in between 11.00 a.m. to 1.00 p.m. until filing of charge sheet;

(ii) shall stay on the address mentioned in the application and shall not change the same without permission of the Court. (iii) shall not indulge in any activity of tampering prosecution evidence and /or indulge in any activity hampering the progress of the trial;

(iv) shall not commit any offence while being on bail granted by this order.

The application stands disposed of.
