ORAL ORDER :

1.For the reasons recorded in the order
dated 30th January, 2013, the applicant has been
granted ad-interim protection in terms of Section
438 of the Code of Criminal Procedure. The reply
filed by the prosecution opposing the request does

not reveal any particular aspect requiring the
custodial interrogation of the applicant except the
recovery of the sword which was allegedly possessed
by him at the time of incident. Significantly
enough, upon query the learned A.P.P. has submitted
that it is not the allegation of the prosecution
that the applicant has used the said sword for
assaulting any person.

2.Having regard to the same, it is difficult
to negative the prayer for anticipatory bail made
by the applicant when the other co-accused
similarly placed like him are released on
Anticipatory Bail by the Court of Sessions. Hence,
ad-interim direction given on 30th January, 2013 is
hereby confirmed subject to the modification that
in the event of arrest of the applicant in
connection with Crime No.378/2012 of Chalisgaon
Police Station, he be released on bail upon
execution of P.R. Bond in the sum of Rs.50,000/-
(Rs. Fifty Thousand) with one or more sureties to
make up the like amount and subject to the
conditions that applicant :-

(i)shall attend the Investigating Officer on
every day in between 11 a.m. to 1.00 p.m. up till
2nd March, 2013 and thereafter as and when required
by the Investigating Officer in connection with the
investigation.

(ii)shall stay at the address mentioned in the
application and shall not change the same without
the permission of the Court.

¶21

(iii)shall not directly or indirectly, make any
inducement, threat or promise to any person
acquainted with the facts of the accusation
levelled against him so as to dissuade him/her from
disclosing such facts to the Investigating Officer.

(iv)shall not commit any offence while enjoying
the benefits granted under this Order.
