1. Heard learned counsel for the parties.

2.The Applicant prays for bail in

connection with Crime No.99 of 2012 registered
with Bhingar Camp Police Station, Dist-Ahmednagar,
for offence under Sections 307 read with 34 of the
Indian Penal Code.

3.The prayer is vehemently opposed by the
learned A.P.P. by pointing out that the Applicant
was absconding for a period of one month and his
involvement is more, from the material collected
during the investigation, in commission of the
offences alleged against him. The said submissions

are countered by the learned counsel for the
Applicant by stating that charge-sheet is filed
and he is not charge-sheeted for an offence
punishable exclusively for imprisonment for life.

4.Having regard to the said facet and the
offence for which the Applicant is charge-sheeted
being not exclusively punishable for imprisonment
for life and the learned A.P.P. having not refuted
the submission canvassed that injured is out of

danger and the perusal of the charge-sheet not
revealing any circumstances for not exercising the
discretion in favour of grant of bail, hence
following order:

5.The Applicant is directed to be released
on bail in connection with Crime No.99 of 2012, on
furnishing P.R. Bond in the sum of Rs.1,00,000/-
(Rupees One Lakh only) with one or more sureties
in the like amount and subject to conditions that
Applicant after his release:

(i) shall attend the Investigating Officer on
every alternate day until further orders.

(ii) shall stay at the address mentioned in the
Application and shall not change the same without
the permission of this Court.

(iii) shall not indulge in any activity of
threatening the prosecution witnesses and/or

indulge in any activity hampering the progress of
the trial.

(iv) shall not commit any offence while on bail.
