applicant was a partner of a construction company – Radhakrishna Construction. Respondent No.2 had purchased Shop Nos.1 and 2 in the Dindoshi Ekta Co-operative Housing Society. The respondent no.2 alleges that the negotiations in respect of the sale were with the applicant and one Jagdish Lakhani. According to the first informant, the applicant had also given him a confirmation letter on 5/11/2009 in respect of the booking of the two shops. On 27/11/2009, the shops were sold to the first informant and accordingly a document, evidencing the sale, was registered before the Sub Registrar. The first informant had purchased Shop Nos.1 and 2 for Rs.89,65,000/- and Rs.87,15,000/- respectively. According to the first informant, the applicant had executed the receipts in respect of the payment which had been received for the shops. According to the first informant, the possession of the said shops was to be given to the first informant some time in March, 2010. The first informant had paid all the dues, including the dues which were demanded subsequently. The applicant had informed the first informant that since there was delay in the completion of the construction, the possession of the shops would be given to the first informant somewhere around June, 2011.
