the Court is informed that the cut off time for taking admission is at 1700 hours today. In our view, it would be necessary to protect the admission which was granted to the Petitioner by the Second Respondent. There is no dispute about the factual position that the Petitioner was, in accordance with her position in the All India Merit List, duly allotted a seat in the the First Respondent by the Second Respondent. Be that as it may, the Court must also take into account the fact that the Second Respondent has made an allotment of three additional students who are required to take admission by 1700 hours today. A copy of the time schedule is annexed at Exhibit-G to the Petition which shows that students who have been allotted under the 15% All India quota for Undergraduate Medical seats have to report at the institution by 14 September 2012 by 1700 hours. In the circumstances, we direct that in the event that any of the three students allotted by the Second Respondent does not report for admission shortly before the end of the cut off time of 1700 hours today, the Second Respondent shall allot the seat to the Petitioner in accordance with the allotment made by the Second Respondent on 22 August 2012. As already noted earlier, the Petitioner had taken admission in pursuance of the allotment and paid her fees. In the event that all the three students do report before the expiry of the cut off time, it would unfortunately not be possible for the Court to accede to the request of the Petitioner since those students are not before the Court.
