790 . In the present case, the petitioners have a serious issue of debate which has to be urged before the Management Council. That includes the question as to whether the Management Council has the power to impose a penalty under the provisions of the Maharashtra University of Health Science Act, 1998. We are not expressing any opinion on any of the rival contentions in view of the fact that there has been a breach of the principles of natural justice. We accordingly set aside the impugned decision of the Management Council as communicated to the petitioners on 2.8.2011 and remand the matter for a fresh disposal. The Management Council shall decide upon the recommendations made by the Grievance Redressal Committee of the University after furnishing to the petitioners an opportunity of a personal hearing. We may also note the contention of the petitioners that as a matter of fact they have temporarily appointed a Scheduled Caste teacher until the final selection is made and the petitioners undertake to this Court to ensure that all the concerned Rules and Regulations of the University for filling up the reserved and other posts in accordance with the applicable provisions of law, including the relevant Government Resolutions dated 19.5.2011 and 2.8.2011 would be initiated within a period of two weeks from today, if it has not already been initiated. We leave open all questions to be considered by the Management Council including the issue as regards the eligibility of the reserved category candidate who has been appointed
