The present Writ Petition is filed against the order rejecting an application for interim protection during pendency of Appeal. The said application is rejected. Aggrieved thereby, the present Writ Petition is filed.

Mr. Tungar, learned counsel for the petitioner submits that as the application of the present petitioner/original plaintiff was rejected, the respondent filed an application for police protection. As such, the present petitioner had filed an application in the pending Appeal before the District Court for interim orders. The said application has been erroneously

rejected.

Mr. Padalkar, holding for Mr. R.S.Deshmukh, learned counsel for respondent no. 2 supports the order.

Though the learned counsel for respective parties have canvassed their submissions, I am not required to consider the same as the impugned order is passed in the month of June and the District Court can be directed to decide the Appeal as it is now fixed for final arguments.

The District Court shall decide the Misc. Civil Appeal expeditiously and preferably within three ( 3 ) months from today.

The Writ Petition is accordingly disposed off, however, with no order as to costs.
