After hearing Mr. Kadam, learned counsel for the petitioner for some time, Ms. Gajare, learned APP appearing for respondent Nos. 1, 2 & 3 after taking instructions from Mr. D. Jadhav, Police Sub-Inspector attached to Yellow Gate Police Station, who is present before the Court, seeks leave to withdraw Show Cause Notice dated 3rd September, 2011, under Section 59 of the Bombay Police Act (for short “the Act”) as well as order dated 19th December, 2011, under Section 56 of the Act under which the petitioner was externed for a period of one year from Mumbai and Mumbai Suburbs, with liberty to initiate fresh action under Sections 59 and 56 of the said Act. Leave with liberty as prayed for, is granted. In view of the withdrawal of the show cause notice and order under Sections 59 & 56 of the Act respectively, the order passed by the appellate authority in an appeal will not survive. The writ petition accordingly stands disposed of, as withdrawn.
