The petitioners were the students of respondent No.3 Pharmacy College for first year. The results have been declared. Unfortunately, thereafter, respondent No.3 college was closed down. The petitioners' prayer is to direct respondent No.3 College to issue Transfer Certificate to the petitioners, as they desire to take admission in some other college.

Learned counsel for the petitioner submits that the State Government did not reimburse the tuition fees for imparting education to backward class students, like the petitioners and therefore, respondent No.3 is not handing over the Transfer Certificate.

Shri Natu, learned Advocate for respondent No.3 submits that inspite of filing the proposal for reimbursement, respondent No.3 could not get the reimbursement from the State Government. He further submits that respondent No.3 College has challenged the order of withdrawal of the approval.

Learned AGP has filed affidavit-in-reply and based thereon submitted that the last date for filing the proposal / application by the

institutions was 27.3.2012, whereas, respondent No.3 filed the proposal on 17.4.2012 and therefore, the State was unable to consider such request.

In this petition filed by the students belonging to backward class category, we would address the issue in respect of handing over of Transfer Certificates.

On instructions, Shri Natu, learned Advocate submits that the Transfer Certificates would be handed over to the petitioners within a week from today. He further submits that the State be directed to reimburse the amount of fees of these students. This issue could be addressed in an appropriate proceeding, initiated by respondent No.3 College, in case need arises. We keep all issues open, on that count.

On the statement made by Shri Natu, learned Advocate for respondent No.3 regarding it's willingness to hand over Transfer Certificates to the petitioners, Writ Petition stands disposed of.
