The petitioner claims to be belonging to "Tadvi", a Scheduled Tribe. The petitioner is a student of B.D.S. course. He appeared for the First Year BDS Examination. His result is withheld.

The learned counsel appearing for respondent No.5-the Scheduled Tribe Certificate Scrutiny Committee,

Aurangabad, submits that within three months the Committee shall decide the proposal of the petitioner for caste verification.

In the facts of the case and considering the submissions advanced we pass following order:--.

(A) The petitioner's result of First Year BDS Examination is ordered to be declared.

¶29

(B) The petitioner is entitled to continue his admission for Second Year BDS course if he satisfies other eligibility conditions.

(C) The respondent No.5-Scheduled Tribe Certificate Scrutiny Committee, Aurangabad is directed to decide the proposal of the petitioner for caste verification within three months. The petitioner shall cooperate with the Committee. The petitioner shall appear before the Committee on 15^th October 2012 at 11.00 a.m.

(D) In case the petitioner fails the respondents-authority would take necessary steps in accordance with rules and regulations.

The petitioner's appearance in the examination would be provisional in nature. The petitioner shall not claim any equity in case he fails to get validity certificate.
