A communication addressed by the petitioner from jail has been registered as a Criminal Writ Petition. We had accordingly appointed Ms.Sonali Saware, learned counsel, to represent the petitioner in this petition.

The grievance of the petitioner is that the offence in which he has been convicted under Section 304-II of the Indian Penal Code is on account of false accusations which have been made against the petitioner. Undisputedly, the petitioner has been convicted in the trial and therefore, it would not be open for this court to reopen the investigation at this stage even in the exercise of writ jurisdiction under Article 226 of the Constitution of India. In that light of the matter,

therefore, this writ petition, which sans merit, is summarily dismissed with no order as to costs.

The fees payable to the learned counsel appointed for the petitioner is quantified at Rs.1500/-.
