Learned Additional Public Prosecutor states on instructions that on the basis of the report of the petitioners, an offence under Section 420 read with Section 34 of the Indian Penal Code has been registered and the necessary investigation is being carried out by the Investigating Officer. On the strength of the said statement Mr. S.S.Jaiswal, learned counsel for the petitioner seeks to withdraw this petition with liberty to file a petition seeking transfer of investigation, in the event it transpires that the investigation is not being carried out diligently or in accordance with law.

We accordingly dismiss this petition as withdrawn with liberty as prayed for, with no order as to costs.
