In view of our order dated 13.4.2011 the civil application is not tenable. This court has already held in order dated 13.4.2011 that though the claim of the petitioner as belonging to Koshti S.B.C. has been invalidated, the petitioner admittedly belongs to Halbi Scheduled Tribe and in that case also he is exempted from payment of fees. Hence, the civil application is rejected and disposed of.
