Mr.Suresh Kumar learned Counsel for the petitioner relies on the judgment of the Supreme Court in Union of India Vs.Pushpa Rane & Ors decided on 29.7.2008 in SLP No.5045 of 2007 wherein the Supreme Court has held that the reservation is applicable even in cases of re-structuring of the cadre resulting in upgradation.

2 In the circumstances, we consider it appropriate to vacate the interim order dated 20.10.2008. In the meantime, there shall be interim stay of the judgment of the Tribunal. Put up the matter for final hearing in the week commencing from 18.6.2012. Civil Application disposed of.
