PER COURT :-

1] The civil application has been filed by respondent No.4 in the petition i.e. management. The original petitioner was appointed as Physical Director. However, his appointment was not approved by the University since he did not possess the necessary qualification as prescribed by the UGC. There is no interim relief granted in the petition. In the management, since the post of Physical Director is vacant, the petitioner had approached the university for grant of permission to issue advertisement and/or to take steps to fill in the said post. The said permission has been rejected on the ground that the petition is pending before this court.

2] We find that the stand taken by the University is not sustainable. There is no interim order passed by this court. As such, there shall be no impediment in permitting the present applicant to proceed further in filling up the post of Physical Director, in accordance with law. Civil application is, therefore, allowed in terms of prayer clause (B).
