This Court on 13/01/2012 had passed an order allowing the applicant to withdraw the amount of Rs. 3,00,000/[ Rupees Three Lacs only ] deposited by the non applicant on the condition of furnishing undertaking.

Mr. Karpe, the learned counsel for the applicant submits that in fact the amount deposited by the non applicant is Rs. 6,00,000/- [ Rupees Six Lacs only ] as per the order passed by this court in Writ Petition and erroneously amount of Rs. 3,00,000/- [ Rupees Three Lacs only ] is observed in para no. 3

of the said order.

The learned counsel for the respondent agrees that the non applicant has deposited the amount of Rs. Rs. 6,00,000/[ Rupees Six Lacs only ].

In view of the above, the Order dated 13/01/2012 is corrected and in stead of amount of Rs. 3,00,000/- [ Rupees Three Lacs only ] appearing in para no. 3 line no. 2 of the said order, it shall be read as Rs. 6,00,000/- [ Rupees Six Lacs only ]. The applicant is allowed to withdraw Rs. 6,00,000/[ Rupees Six Lacs only ] on furnishing an undertaking to this Court that in the event the Writ Petition is allowed, the applicant would deposit the said amount along with interest as would be directed within the period of one ( 1 ) month.

The Civil Application is disposed of. No costs. 1
