The Accused/Applicant Abhay in custody in C.R. No.46 of

2012, registered with Khandala Police Station for an offence punishable under Section 498-A, 306, 494 r/w. 34, 199, 200 of I.P.C., has urged for bail.

The Applicant is in custody from 7^th March 2012. Charge-

sheet is filed. The Accused/Applicant allegedly married the

deceased before 11 months even during subsistence of his earlier marriage. He has allegedly ill-treated the deceased. Record illustrate, before the incident dated 7^th March 2012, he was away at Kolhapur with his family members. A threat allegedly exerted by him, will not, by itself will be sufficient to primarily implicate him for abatement. The statement of few witnesses including Smt. Anita speaks of earlier events before four months, as the Accused Abhay and his wife allegedly assaulted deceased Madhavi to remove herself from the company of Abhay. Considering the nature of accusations, charge-sheet is already filed, no other criminal record, the Accused/Applicant be released on bail. Hence order :-

(a) The Accused/Applicant be released on furnishing PR bond and Surety in the sum of Rs.25,000/- (Rupees Twenty Five Thousand), on a condition to attend the concerned Police Station on every first Sunday of the month between 3.00 p.m. to 6.00 p.m. till conclusion of trial. He shall not influence the witnesses and not to indulge in illegal activities or terrorize the witnesses.

(b) The Accused/Applicant shall not enter jurisdiction of Kolhapur District without prior permission of either the Court or the Investigator, for a period of one year.

(c ) The Accused/applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as

to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
