un-wedded sister, she had maintained silence. This explanation, prima facie, is quite plausible. However, at this stage learned Advocate Smt. S.G. Chincholkar for the applicant/ accused submitted that the complainant was with her father for more than one year, and, therefore, she could have lodged the complaint during that period. However, it needs to be observed that for a Indian housewife with such back ground what matters more is security of matrimonial ties. No where it is revealed, that this lady enjoyed enough economic independence to throw away shackles of her marriage and rush to the Police station making serious grievance of rape against brother-in-law with whom she had no private or personal grudge and that too at the expense of her image. She revealed that her husband was not ready to resume cohabitation, and therefore, she had lodged the complaint. It is also revealed in the complaint that her father had made efforts for resumption of the conjugal relations but her in-laws did not allow its resumption. Evidently, the complainant had lost hope and ultimately lodged the complaint. Prima facie, the complaint therefore, cannot be said to be devoid of any plausible explanation and one made with any oblique motive out of private or personal grudge against the applicant.
