1. Heard both sides.

2.The present applicant who is arrested by Wadwani
Police Station in crime no. 91 of 2012 for the offence
punishable under section 307,353,504 and 506 of the I.P.C.
and section 25/4 of the Indian Arms Act, is praying for
his release on bail.

3.The complaint is filed by the Police Constable
of Police Station, Wadwani on 16.7.2012. He has alleged
that the present applicant barged into the Police Station,
while the Police Head Constable was carrying his official
duties. At that time, the present applicant questioned

the Police Head Constable as to why the Police was filing
cases against him. During the exchange of words, the
applicant flashed a revolver and pointing the same at the

chest of the complainant, threatened him. Some of the
other Police Constable apprehended the applicant and
therefore the applicant was arrested.

4.The learned counsel for the applicant submits
that he is falsely involved in the false offence and false
recovery of the country revolver is shown. Investigation
is complete. Hence, he submits that the applicant be
released on bail.

5.Learned A.P.P. however submits that 10 offences
are already registered against the present applicant with
Dindrud Police Station and Wadwani Police Station,
however, he continues with his criminal activities and
hence he submits that the application be dismissed.

6.Learned counsel for the applicant further
submits that the applicant is already acquitted in many of
the cases. The nature of the offences are relatively
minor and that too due to the involvement of the officials
in such cases. Only out of political rivalry, various
criminal cases are lodged against him.

7.Considering the nature of the allegations and
finding that the investigation is complete, in my view,
the applicant can be released on bail on certain stringent
conditions.

8. In the circumstances, the following order:-

I)The applicant be released on bail in crime
no. 91 of 2012 registered at Wadwani Police Station, Dist.
Beed for the offence punishable under section 307,353,504
and 506 of the I.P.C. and section 25/4 of the Indian Arms

Act, upon his execution of PR bond in the sum of
Rs.20,000/- and also upon furnishing surety in the like
sum.

II)The applicant shall not enter the territorial
limits of Beed District except for attending the Court
cases without the prior permission of the concerned Judge
for a period of three (3) years or till the conclusion of
the trial, whichever occurs earlier.

III)At the time of execution of the PR bond, the
applicant shall give his fresh full address alongwith his
mobile number and shall also send a copy of the same to
the I.O. by R.P.A.D. within a period of 10 days from
furnishing of the PR bond.

9. Application disposed of accordingly.
