2.The present applicant who is convicted by

the learned Additional Sessions Judge-4, Ahmednagar

in Sessions Case No. 59/2010, for the offences
punishable under section 363, 366 and 376 of the I.P.

Code and sentenced to suffer for various terms out of

which five years' rigorous imprisonment is awarded

for the offence punishable under section 376 of the

I.P. Code, is praying for his release on bail during
pendency of the criminal appeal.

3.The fine amount is already deposited by the
applicant/appellant. The applicant was enlarged on
bail during the pendency of the trial. In the
circumstances, the application is allowed. The
substantive sentences awarded to the applicant are
hereby suspended till the disposal of Criminal Appeal
No. 528/2012. The applicant, namely, Dada s/o Sagaji
Kolpe, be released on bail upon his executing a PR
bond in the sum of Rs. 20,000/- and also upon
furnishing a surety in the like amount. The present
application is accordingly disposed of.
