ORAL ORDER:

1.Upon hearing both the sides, learned counsel for
the applicant submits that the applicant wishes to
withdraw the present application, with liberty to file
similar application in the Sessions Court which shall be
decided on its merit by the learned Sessions Judge, as
expeditiously as possible.

2.He however submits that on 22.11.2012 a meeting
of the District Planning and Development Committee is
going to be held. He places on record a letter issued to
the present applicant who is a M.L.A. Therefore, he
submits that the applicant may be permitted to attend the
said meeting.

3.Considering the nature of the allegations made
against the applicant and the fact that he has to approach

the Sessions Court, the Application is disposed of as
withdrawn, with liberty as prayed for and with the
direction to the learned Sessions Judge to decide the
application as expeditiously as possible. The applicant
is allowed to remain within the territorial limits of
Parbhani city on 22.11.2012.
